Fred Kim has been counseling clients about patents since 1994. He has extensive experience in all aspects of intellectual property law, such as negotiating license agreements, directing intellectual property due diligence investigations, conducting pre-litigation patent analysis, supporting patent litigation, and preparing patent non-infringement and invalidity opinions. Today, his practice focuses on patent portfolio development for both emerging technology companies and multi-national companies in the field of nanotechnology, Internet software, graphics processing and semiconductor fabrication processes. He counsels his clients on complex intellectual property issues that arise during venture capital financing, corporate deals and licensing transactions. Dr. Kim also assists clients in the evaluation of patents when they are threatened with allegations of infringement and, where necessary, renders legal opinions related to non-infringement and/or patent invalidity for these clients. Dr. Kim is fluent in Korean.
Prior to joining the firm, he was an associate at Skadden, Arps, Slate, Meagher & Flom for more than three years. In that time, he worked on intellectual property transactional and licensing matters and frequently advised clients on intellectual property issues that arose during corporate transactions. This experience included two multi-billion dollar deals where he was the primary IP counsel representing the acquirer.
Dr. Kim began his legal career in the Electronics Practice Group of Foley & Lardner where he prepared and prosecuted patent applications for six years and counseled large multi-national clients on patent infringement and validity issues. Dr. Kim also has in-house experience with an Internet company, BtoBapparel.com, where he served as General Counsel and as a Director on the board. As General Counsel, Dr. Kim managed all of the legal affairs of the company and oversaw the development of the company's patent portfolio.
Prior to his legal career, Dr. Kim worked as an aerospace engineer at NASA Ames Research Center where he developed flight simulation models. He also worked on developing flight simulation models while earning his master's degree and Ph.D. in Aerospace Engineering from the University of Maryland under a U.S. Army Rotorcraft Fellowship. Dr. Kim received his J.D. from the Georgetown University Law Center, graduating cum laude. He has been a member of the California bar since 1997 and has been registered to practice before the U.S. Patent and Trademark Office since 1994.
